Refund Policy

Thank you for choosing Lovechat (“the Service”). We aim to provide a satisfying adult AI chat experience based on a points purchase model (“Points”) for access to premium features. This Refund Policy clarifies the terms and conditions under which refunds may or may not be granted.

1. General Non-Refundable Policy

  1. Points as Consumable Digital Goods
    • Any Points or digital credits purchased are immediately accessible upon transaction completion and can be consumed instantly for our character chats or other premium content.
    • Because of this instant consumable nature, all Points purchases are final and non-refundable.
  2. No Refund for Dissatisfaction
    • We do not offer refunds based on user dissatisfaction with AI outputs, roleplay scenarios, or any subjective quality concerns.
    • Users are responsible for making informed decisions before buying Points, as the Service’s content is highly variable and personalized.
  3. Scope & Application
    • This policy applies to all Points purchased directly through our platform or affiliated payment methods, unless otherwise mandated by specific app store policies or local laws.

2. Exceptions & Special Circumstances

While we maintain a general no-refund stance, limited exceptions may apply:

  1. Technical Error or Non-Delivery
    • If a purchase is completed (payment charged) but the Points are not credited due to a technical error, please contact Support (contact@lovech.at) within 7 days of the transaction.
    • Once verified, we will either provide the missing Points or, if we cannot resolve it, issue a partial or full refund.
  2. Duplicate or Accidental Charges
    • If you notice duplicate or accidental billing (e.g., multiple charges for one transaction), contact us promptly with supporting evidence (transaction IDs, receipts).
    • We reserve the right to investigate and, upon confirmation, arrange a refund or credit accordingly.
  3. Local Consumer Law Compliance
    • Where local laws require refunds for digital goods under specific conditions, we will comply to the extent necessary. For instance, if EU/EEA law imposes a statutory “cooling-off period,” we note that Points usage constitutes immediate performance of digital content, and by using Points promptly, you waive the right of withdrawal under 2011/83/EU (Consumer Rights Directive) once the digital service is fully performed or accessed.

3. Chargeback & Dispute Handling

  1. Unauthorized or Fraudulent Transactions
    • If you suspect your payment method was used without authorization, immediately notify both us and your payment provider. We will investigate possible fraud.
    • If found valid, we may refund or reverse the unauthorized charge. However, if the account usage indicates Points consumption, a refund might be limited or denied.
  2. Chargebacks / Payment Disputes
    • Filing a chargeback without first contacting us is strongly discouraged. Repeated or fraudulent chargebacks may result in account suspension or termination.
    • We reserve the right to pursue further legal or collection measures if a chargeback is deemed fraudulent.

4. Account Termination & Forfeiture of Points

  1. User-Initiated Deletion
    • If you voluntarily delete your account, any remaining Points or subscription time are forfeited. No refund or reactivation of those Points is provided.
  2. Suspension / Ban for Violations
    • If your account is suspended or terminated for violating our [Community Guidelines] or [Terms of Service], any unused Points are non-refundable.
  3. Minors or Unauthorized Users
    • We do not allow under-18 users. If an account is found to be operated by a minor, we may immediately terminate the account. Points associated with underage or unauthorized use will not be refunded.

5. Responsibility & Disclaimers

  1. Adult Content Disclaimer
    • The Service may include explicit or adult-oriented content. Users acknowledge that results from AI or user-generated scenarios can vary and might not match every expectation.
    • Dissatisfaction with our content, scenario direction, or AI responses does not constitute grounds for a refund.
  2. Immediacy of Consumption
    • By purchasing Points, you agree that the digital goods are made available instantly, thus fulfilling their “performance” once credited. Consequently, you waive any statutory right of withdrawal where applicable (e.g., EU Consumer Rights Directive) upon usage of the Points.
  3. No Liability for Personal Preferences
    • We cannot guarantee specific AI outcomes or erotic scenarios. Users are fully responsible for their own choices of how Points are spent.

6. How to Request Assistance or Refunds

  • If you believe you qualify for a refund under the limited Exceptions (e.g., duplicate charge, non-delivery), please provide:
    • Transaction IDs or receipts
    • Date & time of purchase
    • Description of the issue (technical error, duplicate billing, etc.)
